RE: The tariff classification of a 100% cotton rib knit fabric from El Salvador.

Dear Ms. Carothers:

In your letter dated May 1, 2008 you requested a classification ruling. The sample is being returned as requested.

The submitted sample, designated as style 2754 “Swiss Rib Fabric”, is a 2 X 2 rib knit fabric composed of 100% cotton. It is constructed using 26/1 c.c. cotton yarns and is characterized by distinct raised ribs running the length of the fabric. The marl or mixture yarns that form this product have been spun with fiber of different colors creating a gray heather appearance. This seamless circular knit tubular fabric is 25 centimeters wide when measured flattened.

The applicable subheading for the 100% cotton rib knit fabric will be 6003.20.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for knitted or crocheted fabrics of a width not exceeding 30 centimeters, other than those of heading 6001 or 6002, of cotton, other. The duty rate will be 8 percent ad valorem.

This fabric falls within textile category 222. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
